1. ACCEPTANCE OF TERMS
By accessing, downloading, installing, or using the Monitizr Services, whether or not you become a registered user (“User”, “You”, “Yourself”, “Your”), You agree to be bound by these Terms, which You acknowledge that You have read and understood.
We reserve the right, at Our sole discretion, to change, modify or otherwise alter these Terms at any time. You must review these Terms on a regular basis to keep Yourself informed of any changes.
2. EARNINGS AND INCOME DISCLAIMER:
Monitizr can not and does not make any guarantees about your ability to get results or earn any money with our ideas, information, tools, or strategies. What we can guarantee is your satisfaction with our training. We give you a 30-day 100% satisfaction guarantee, so if you are not happy for any reason with the quality of our training, just ask for your money back. You should know that all products and services by our company are for educational and informational purposes only. Nothing on this page, any of our websites, or any of our content or curriculum is a promise or guarantee of results or future earnings, and we do not offer any legal, medical, tax or other professional advice. Any financial numbers referenced here, or on any of our sites, are illustrative of concepts only and should not be considered average earnings, exact earnings, or promises for actual or future performance. Use caution and always consult your accountant, lawyer or professional advisor before acting on this or any information related to a lifestyle change or your business or finances. 3. SUBSCRIPTIONS, TRIALS AND DIGITAL PRODUCTS
Free Trials: Your Monitizr membership may start with a free trial. The free trial period of your membership lasts for one month, or as otherwise specified during sign-up and is intended to allow new and certain former members to try the service.
Free trial eligibility: Eligibility is determined by Monitizr at its sole discretion and we may limit eligibility or duration to prevent free trial abuse. We reserve the right to revoke the free trial and put your account on hold in the event that we determine that you are not eligible. Members of households with an existing or recent Monitizr membership are not eligible. We may use information such as device ID, method of payment or an account email address used with an existing or recent Monitizr membership to determine eligibility. For combinations with other offers, restrictions may apply.
Trial Billing: We will charge your Payment Method for your monthly membership fee at the end of the free trial period and your membership will automatically renew monthly unless you cancel your membership prior to the end of the free trial period.
Billing Cycle: The membership fee for the Monitizr service any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your Payment Method on the calendar day corresponding to the commencement of the paying portion of your membership until your membership is cancelled. Membership fees are fully earned upon payment. In some cases your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month.
Cancellation: You can cancel your Monitizr subscription at any time, and you will continue to have access to the Monitizr service through the end of your monthly billing period. We do not provide refunds or credits for any partial-month membership periods. If you cancel your membership, your account will automatically close at the end of your current billing period.
Excessive returns will not be accepted. Refunds will not be given to any one customer for one specific product more than twice. There is an unlimited amount of orders that a customer can place for one specific product, but the money back guarantee is void after a customer has used it for one specific product more than twice.
4. THE RESELLER GUARANTEES
Monitizr shall only be obliged to offer a double money back guarantee (the "Double Guarantee") to the Reseller, and only under the following stringent conditions: Firstly, the Reseller must establish and maintain a dedicated landing page for a minimum continuous period of sixty (60) days. Secondly, the Reseller must demonstrate, with valid and verifiable evidence, that they have effectively driven substantial traffic to the aforementioned landing page during the specified period. Thirdly, the Reseller must prove that they have set up a series of indoctrination emails and the Digital Marketing Domination email course in their autoresponder system. This proof should be in the form of detailed documentation or screenshots, as required by Monitizr. Failure to meet any of these conditions in full will render the Double Guarantee null and void, and Monitizr shall be under no obligation to honor the Double Guarantee or to pay any compensation whatsoever to the Reseller.
However, notwithstanding the above, Monitizr will still honor a 100% money back guarantee (the "Standard Guarantee") if a Reseller, not qualifying for the Double Guarantee, is unsatisfied with the program and wishes to close their reseller account. The Standard Guarantee will be given upon receipt of a formal written request from the Reseller to close their account, and it will constitute a full refund of the Reseller's initial fee, without any obligation for additional compensation.
5. INTELLECTUAL PROPERTY
You agree that the Monitizr, including but not limited to Monitizr Products and services, graphics, user interface, audio clips, video clips, editorial content, templates and the scripts and software used to implement Monitizr Services, contains proprietary information and material that is owned by Monitizr and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever except for use of the Monitizr Services in compliance with this Agreement. No portion of the Monitizr Services may be reproduced in any form or by any means, without expressed written permission from Monitizr. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Monitizr Services in any manner, and you shall not exploit the Monitizr brand in any unauthorized way whatsoever, including, but not limited to, by trespass or burdening network capacity.
Notwithstanding any other provision of this Agreement, Monitizr and its licensors reserve the right to change, suspend, remove, or disable access to any Monitizr products, content, or other materials comprising a part of the Monitizr brand at any time without notice. In no event will Monitizr be liable for making these changes. Monitizr may also impose limits on the use of or access to certain features or portions of Monitizr services, in any case and without notice or liability.
All copyrights in and to Monitizr (including the compilation of content, postings, links to other Internet resources, and descriptions of those resources) and related software are owned by Monitizr and/or its licensors, who reserve all their rights in law and equity. THE USE OF THE SOFTWARE OR ANY PART OF MONITIZR, EXCEPT FOR USE OF MONITIZR AS PERMITTED IN THIS AGREEMENT, IS STRICTLY PROHIBITED AND INFRINGES ON THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS AND MAY SUBJECT YOU TO CIVIL AND CRIMINAL PENALTIES, INCLUDING POSSIBLE MONETARY DAMAGES, FOR COPYRIGHT INFRINGEMENT.
Monitizr, the Monitizr logo, other Monitizr trademarks, service marks, graphics, and logos used in connection with Monitizr are trademarks or registered trademarks of Monitizr. in the U.S. and/or other countries. Other trademarks, service marks, graphics, and logos used in connection with Monitizr Services may be the trademarks of their respective owners. You are granted no right or license with respect to any of the aforesaid trademarks and any use of such trademarks.
